This End User License Agreement (“Agreement”) is a legal contract between you (either an individual or a single entity) and the Licensor regarding your use of our Apps (“our Apps”).

IMPORTANT: BY DOWNLOADING OR USING OUR APPS, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE OUR APPS.

1. License Grant

The Licensor grants you a limited, non-transferable, non-exclusive, revocable license to download, install, and use our Apps on any Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and Conditions.

This license is solely for personal, non-commercial use and in accordance with the Apple App Store Terms of Service.

2. Restrictions

You may not:

  • Distribute or make our Apps available over a network where it could be used by multiple devices simultaneously
  • Rent, lease, lend, sell, redistribute, or sublicense our Apps
  • Copy, reverse-engineer, decompile, disassemble, modify, or create derivative works of our Apps
  • Circumvent or attempt to circumvent any security mechanisms of our Apps
  • Use our Apps for illegal purposes or in violation of any applicable laws or regulations

3. Ownership and Intellectual Property

Our Apps is licensed, not sold. All rights, title, and interest in and to our Apps (including but not limited to code, design, graphics, content, and documentation) are owned by the Licensor.

All trademarks, service marks, and logos used in our Apps are the property of their respective owners. You acquire no ownership rights under this Agreement.

4. Consent to Use of Data

Only Hashes does not collect personal data, use third-party SDKs, or engage in behavioral tracking.

However, you acknowledge and agree that our Apps may access third-party APIs for real-time data (e.g., market prices, blockchain data, news), and you consent to these anonymous, data-only requests as part of normal functionality.

5. Termination

This license is effective until terminated by you or the Licensor. Your rights under this license will terminate automatically without notice from the Licensor if you fail to comply with any term(s) of this Agreement.

Upon termination, you must cease all use of our Apps and delete all copies from your device.

6. No Warranty

Our Apps are provided “as is” and without warranty of any kind. The Licensor disclaims all warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Licensor does not warrant that:

  • Our Apps will meet your requirements
  • Our Apps will operate without interruption or error
  • The information provided will be accurate or reliable

7. Limitation of Liability

To the maximum extent permitted by law, the Licensor shall not be liable for any damages, including but not limited to incidental, consequential, indirect, or punitive damages, arising out of your use of or inability to use our Apps—even if the Licensor has been advised of the possibility of such damages.

8. Apple Terms and Acknowledgements

This EULA is between you and the Licensor, not Apple. However:

  • The Licensor is solely responsible for our Apps and its content
  • Apple has no obligation to provide maintenance or support
  • In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if applicable)
  • Apple is not responsible for addressing any claims relating to our Apps or your use of it
  • You must comply with applicable third-party terms of agreement when using our Apps (e.g., data source APIs)

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Kentucky, without regard to conflict of law principles.
